By a decision of January 14, 2019, the Kuntsevsky District Court of Moscow completely dismissed the claim of Ruslan Kagarmanov against Alexander Revva on copyright protection of the song “Chika”.
June 10, 2019 Judicial Chamber for Civil Cases of the Moscow City Court made the final decision in the court dispute between Mr. Alexander Revva and Mr. Ruslan Kagarmanov.
The decision of the court, which was refused in satisfaction of the requirements for the recognition of the hit song “Chika”, became valid.
Artem Grishin, the lawyer of Moscow Alliance Legal Law Bureau, who defended the interests of Mr. Alexander Revva in court, commented on the verdict rendered by the court:
“Everybody knows Dan Balan’s 2010 hit song “Chika Boom ”, Valery Leontyev’s (1998) song “Chika Chika (from Puerto Rico)”, the song "Chika Chika Chu", performed by Oleg Lundstrem’s jazz orchestra in 50s of the last century.
In addition, about a dozen od songs with the name "Chika" in different variations are registered in the Register of the Russian Authors ’Society.
At the same time, mass litigations between the authors of these works are absent and this is due to the fact that, in addition to the coincidence of song titles, first of all, the borrowing of both musical and linguistic (semantic) components must be proved, which the claimant did not do in the present case.
